Principios jurídicos implícitos en el Estado neoliberal mexicano

Abstract

This article aims to analyze the dimensions of implicit legal principles, consideringthem as “norms-bridge” between the express and underlying world of Law.Traditionally, they are placed in a strictly judicial field, however, this study raisesthe possibility of their presence and expansion throughout the legal system, forexample, in the form, functions, limits and operability of the State. This researchfollowed the following methodological strategy: 1) theoretical analysis of legalprinciples in general; 2) theoretical-methodological inquiry into the implicit legalprinciples, and 3) case studies with which it was possible to identify some implicitlegal principles that sustain the functioning of the Mexican neoliberal state.
