Divorcio y disolución de la sociedad conyugal: disputa y reparto de bienes entre el derecho moderno y las decisiones morales
Abstract
This article intends to give an account of the disputes generated after the dissolution of marital partnership. Through an ethnographic analysis of particular cases, the scenarios where the dispute over goods and resources reveals the rupture of unequal agreements emanating from a Jewish-Christian tradition, which is based on premises that are in crisis in today’s capitalist society, are shown. In this way we maintain that moral assessments hide interests under a rationality that appeals to the dispute over resources within the framework of the legal dimension of the State that has the function of administering justice and mediating the conflict, appealing to the law, resolutions generally challenge the moral assessments of the family.Additional Files
