Abstract

We distinguish in complexity the paradoxical coexistence between the study of nationalized dynamic systems, socially disordered, as is the law defined as ‘coercive order of behavior’, and the epistemic complexity, capable of overcoming disorder in the entities of the world looking at them in a framework tending to stability, constancy, regularity, structure and invariance. We must distinguish the factual reality of law from its ideality as a triad of different intimately intertwined discourses. Only by making the distinction we will be able to point out the performative contradictions. But, the different populisms, especially the criminal one, oppose this knowledge of the law in contingency: they have subordinated the understanding of law to the ‘law of the jungle’ and to the various interests, ideologies and populisms that fight for group satisfaction.
