Los atavismos jurídicos y la implementación de la perspectiva de género en sede judicial

Abstract

Progress in recognizing women’s rights within universal, regional, and national systems is not without its obstacles, setbacks, and even regressions, referred to in this text as “atavisms”. One area where this type of dynamic can be observed is in the administration of constitutional justice, based on the tracking of the term “gender perspective”. This text examines the Mexican case and analyzes the rulings of the Supreme Court of Justice of the Nation to identify the arguments used by the parties and lower courts, which either affirm or deny the application of a gender perspective in each specific case.
