Reforma judicial 2024–2025: legitimidad democrática e independencia judicial en México

Abstract

The article examines the democratic legitimacy of the Mexican judiciary in light of the constitutional reform of 2024-2025, which introduces the direct election of judges, magistrates, and ministers, reduces the number of members of the Supreme Court of Justice of the Nation, and replaces the Federal Council of the Judiciary with new disciplinary and administrative bodies. Based on a historical and normative perspective (1824, 1857, 1917, 1928, 1987, and 1994), recurring tensions between centralization and federalism, as well as between judicial professionalization and democratic representation, are identified.
