The survey focuses on the process of incorporating into traditional command and control based approach of environmental legislation, those principles and rules aimed at making restoration of environmental damages possible. Eventually, the study evaluates the efficiency of the new Federal Law of Environmental Liability. Based on such analysis, this document concludes that the new Environmental Liability Act clearly confronts the non-regression principle
