H. L. A. Hart y el estilo analítico de investigación en la teoría del derecho
Abstract
The aim of this paper is to demonstrate the following thesis: there’s no a necessary connection between analytical jurisprudence and Legal Positivism. From a traditional perspective, it has been stated that analytical jurisprudence is necessarily a form of positivist theory of law. However, this statement is false. In general, analytic philosophy is only a style of philosophical research and not a set of substantive theories. H. L. A. Hart’s positivist theory is a possible paradigm in analytical jurisprudence, but this one can be reformulated in terms of a postpositivist legal conception.Additional Files
